The technical regulation TR EAEU 040/2016 On safety of fish products comes into force

On September 1, 2017, the technical regulation TR EAEU 040/2016 On safety of fish products comes into force. The corresponding resolution has been passed on October 18, 2016.

The technical regulation 040/2016 On safety of fish products contains the mandatory safety requirements for fish and seafood and related processes of production, packaging, storage, disposal, transport, sale for the protection of life and health of humans and animals.

For example, it standardizes the maximum water content: for salmon – max. 72 %, mackerel – 80 %, shrimp – 82 %. Furthermore, it prohibits or limits the use of certain additives that are harmful to the human health.

Seperately, the regulation contains rules on baby and children food. For children in their first year of life, the food has to be manufactured with special facilities. It is prohibited to use phosphates, flavour enhancers, sorbic acid or benzoic acid.

The attestation of conformity with the requirements of TR EAEU 040/2016 takes place in the form of:

  • EAC Declaration
  • state hygienic registration of child nutrition according to TR CU 021/2011 On safety of food
  • animal testing of unprocessed fish products of animal origin, live fish, and live invertebrate aquatic animals

Products certified according to TR EAEU 040/2016 have to be marked with the EAC conformity mark of the Eurasian Economic Union. The conformity mark is to be attached to the packaging, the business documents and the labels in a way that the identifiability is ensured throughout the product's life cycle. A product can only be marked, if it fulfills the requirements of all technical regulations by which it is affected.

Declarations that have already been issued are valid until September 1, 2019.

The certification authorities in the Eurasian Uion have begun cleaning up the EAC certification market by annulling EAC certificates that were issued in violation of regulations. This concerns documents issued by certification bodies that systematically ignored the legal requirements of the technical regulations and issued certificates without conducting real testing.
