TR EAEU 040/2016 On safety of fish products

The Technical Regulation of the Eurasian Economic Union 040/2016 On safety of fish products contains the mandatory safety requirements for fish and seafood and related processes of production, packaging, storage, distribution, transportation and sale for the protection of life and health of humans and animals. The TR EAEU 040/2016 also serves to prevent misleading actions against the consumer. In addition, the Technical Regulation covers seafood and products from the aquaculture of plant and animal origin in processed or non-processed form and should ensure the free movement of goods.

Application area of TR EAEU 040/2016

The Technical Regulation TR EAEU 040/2016 applies to:

fish products and aquacultures, both plant and animal, processed or unprocessed, caught in the natural water bodies
processes of manufacture, packaging, storage, distribution, transportation and sale

The TR EAEU 040/2016 does not apply to:

breeding methods
specialized foodstuffs containing fish and fish products (except baby food)
food supplements made from fish, invertebrate or aquatic mammals, algae or aquatic plants
processes of packaging, storage, distribution, transportation and realization food from fish or fish products intended for selling in the EAEU
non-food products from fish and fish products

The conformity assessment process

The conformity assessment with the requirements of the TR EAEU 040/2016 takes place in the form of:

EAC Declaration
State registration of child nutrition according to the requirements of TR CU 021/2011 On food safety
animal testing of unprocessed fish products of animal origin, live fish and live invertebrate aquatic animals

Accompanying documents

The supporting documents must be submitted in Russian or in the official language of the member state of the customs union. The accompanying documents include:

test reports
data sheet
technical documentation
a copy of the certificate of conformity
a copy of the quality management system certificate
protocols of the manufacturing audit for serial production

The products certified according to TR EAEU 040/2016 must be marked with the EAC conformity marking before launch. The conformity marking shall be attached to the packaging, the accompanying documents and the labels in such a way as to ensure recognition and legibility throughout the life cycle of the product. The marking may only be attached if the product meets the requirements of all Technical Regulations.

Period of validity of EAC Declaration

The EAC Declaration for fish and fish products is valid for five years.

1. What is an EAC certificate?

The EAC certificate of the Eurasian Economic Union (EAEU) is an official document, that proofs the conformity of the products with the harmonized technical regulations of the member states of the EAEU. The products, whose conformity with the technical regulations could be confirmed by the certificate of the EAEU, may be moved and sold in the whole customs area of the member states of the EAEU.

2. What is an EAC declaration?

The EAC Declaration of the Eurasian Economic Union (EAEU) is an official document that proofs, that the products meet the minimum requirements of the technical regulations of the EAEU. An EAC declaration is issued by the manufacturer, importer or an authorized representative and listed in the official register. Those products, whose conformity with the technical regulations are confirmed by the declaration, have the permission to be freely moved and sold in the whole customs territory of the member states of the EAEU.

3.What is the difference between EAC certificate and EAC declaration?

The EAC certificate can only be issued after a quality assessment, which has to be carried out by a certification body accredited in one of the member states of the Eurasian Economic Union. The certification is conducted on the basis of technical documentations, company-internal created test reports, or rather test reports provided by accredited test laboratories, as well as on basis of a manufacturing audit on site. The certificate is printed on an official pre-printed form, which has several forgery-proof elements and is authenticated by the signature and seal of an accredited body. The EAC certificate is usually issued for “complex” products that require an extensive control by the authorities.
With the EAC Declaration the manufacturer, importer or authorized representative declares the conformity of his products with the minimum requirements of the technical regulation of the Eurasian Economic Union (EAEU). As distinguished from the EAC certificate, the EAC declaration is issued by the manufacturer or importer himself. All necessary tests and analysis are or made by the manufacturer or in some cases by the laboratory. The applicant issues the EAC declaration himself on a usual piece of paper. The EAC declaration has to be listed in the uniform register of the EAEU by an accredited certification body of one of the member states of the EAEU.

Type examination for EAC conformity assessment

An important step in the conformity assessment procedure is the testing of product samples, during which the conformity of the products with the respective Technical Regulations of the EAEU is verified. In the case of EAC certification, this may only be carried out in accredited laboratories and must follow specific rules. If it is an EAC declaration, the tests can also be carried out in non-accredited laboratories. A test report is then prepared, which contains the test results as well as information about the manufacturer and the test method.
