  • Frequently asked questions about apostille and consular legalization

Schmidt & Schmidt offers you a qualified Hague apostille service for your public documents issued in the states of Asia in accordance with the Hague Convention Abolishing the Requirement of Legalization for Foreign Public Documents as well as the consular legalization of your documents issued in the states that have not yet acceded to the Convention.

The apostille is a stamp of a rectangular shape. The heading "Apostille (Convention de la Haye du 5 octobre 1961)" written in French is a necessary requirement for the apostille's validity. The Hague apostille confirms the authenticity of the signature, the position in which the signer has acted, and the authenticity of the seal or stamp with which the document is attested. Each apostille is registered and contains the issuance date and a unique number. In each country the apostille is issued by competent authorities designated for each document type.

The apostille has to be obtained in the country that has issued your document. You can find the detailed information about the country-specific requirements for the apostillization in the country information sections.

To date, only few countries in Asia are members of the Apostille convention: Bahrain, Hong Kong, India, Israel, Japan, Macao, Mongolia, South Korea, Oman, Tajikistan, Turkey, and Uzbekistan.

For public document issued in countries who are not members of the Apostille Convention (for ex. China) the consular legalization is required. This is a multi-step procedure which includes the certification of a document in a corresponding ministry, then the Ministry of Foreign Affairs, and lastly, at the consulate of the document's state of destination. The document is only valid in the country whose consulate legalized it.

Frequently asked questions about Legalization and Apostille

1. What is legalization of documents and what is it needed for?

Legalization of a document is a process, which allows to legitimate the document issued in one country for its usage in another. It means, if you want to submit a document, issued in one country, to authorities in a target country, the document must primarily prove its authenticity. Legalization confirms the authority of the issuing official as well as an authenticity of his signature and seal. Legalization is needed for official non-commercial documents.

2. How can the document be legalized for another country?

There are following procedures of legalization of documents:
  • Consular legalization
  • Apostille (a simplified procedure of legalization)
  • Legalization of documents by the Chamber of Commerce and Industry
Consular legalization applies to countries, that have not signed the Hague Convention of 1961, which implemented a law about the procedure of apostille (a lot of European countries are member states of this convention). Legalization of documents through the Chamber of Commerce is carried out in relation to commercial documents (contracts, invoices etc).

3. Is the legalization of the document always required?

No, not always. In some cases, countries can make bi- or multilateral agreements that completely revoke legalization of documents for their recognition in the member countries. For example, a CIEC convention from 1976 or bilateral treaties between Germany and Belgium, Denmark, France, Greece, Italy, Luxemburg, Austria and Switzerland.
