Frequently asked questions about Legalization and Apostille

1. What is legalization of documents and what is it needed for?

Legalization is a procedure that grants legal validity to a document issued in one country so that it can be recognized in another country. It confirms the authority of the issuing officer as well as the authenticity of their signature and seal. Legalization is required for official non-commercial documents.

2. How can the document be legalized for another country?

There are the following procedures of legalization of documents:
  • Consular legalization
  • Apostille (a simplified procedure)
  • Legalization by the Chamber of Commerce and Industry
Consular legalization applies to countries that have not signed the Hague Convention of 1961. The Chamber of Commerce legalizes commercial documents such as contracts or invoices.

3. Is the legalization of the document always required?

No, not always. Some countries have bi- or multilateral agreements that completely revoke legalization requirements. For example, CIEC conventions or bilateral treaties between Germany and Belgium, Denmark, France, Greece, Italy, Luxembourg, Austria, and Switzerland.

4. Where can I make an apostille?

An apostille stamp is applied in the country where the document was issued. The responsible authority is defined by each country that is a party to the Hague Convention of 1961. You can determine the competent authority for each country on the official website of the Hague Convention.

5. Can I apostille a document in the country of destination?

No. The apostille must always be applied in the country where the document was originally issued.

6. What kind of documents can be apostilled?

Apostille is applied to official non-commercial documents of state significance. Commercial contracts, invoices, customs papers, diplomatic and consular documents cannot be apostilled. Documents containing photos (such as ID cards, passports) are not subject to apostillization. The document must be in good physical condition; signatures and seals must be readable. Laminated documents cannot be apostilled.
