Technical Regulation TR CU 041/2017 comes into force on June 2, 2021.

The new technical regulation applies to all chemical substances and replaces national regulations.

A number of measures have been developed to prepare industry for the entry into force of the technical regulation – such as the inventory of the chemical substances.

Inventory is the first step in establishing of the national part of the Register of chemicals substances and mixtures of the Union.

Information from the inventory is then entered in the national part of the Register. If a chemical substance is not listed in the register, it is considered a new substance and requires notification.

All chemicals, either separate substances or as part of the mixtures must be inventoried. In the case of mixtures, all constituents whose concentration is more than 0.1 percent by weight are taken into account.

The inventory of chemical substances is voluntary. The company may submit information about chemicals to be included in the register, thereby declaring “existing” of the chemicals in the customs territory of the Union. After the entry into force of TR EAEU 041/2017, all chemicals, which are not listed in the register, are considered as "new" and must be notified before they can be placed on the market. Notification is a comprehensive study of dangerous properties and an analysis of the risks to human health and the environment. After that a chemical safety report is issued.

For the chemical inventory only minimum information on chemicals is required. It is also not necessary to prove that the substance is already on the Union market. For companies that for some reason have not participated in the inventory and have determined after the entry into force of EAEU TR 041/2017 that their substances are not listed in the register (and are therefore labeled as new chemicals), can until June,2 2023 have the substances entered in the register without notification. However, proof is required that the chemical substance had already been placed on the Union market before TR EAEU 041/2017 came into force. Supply contracts or waybills can serve as evidence.

Authorized representative

Authorized representativeThe manufacturer, which is not established in one of the Member States of the Eurasian Economic Union, is not entitled to apply for any EAC conformity certificate.
In accordance with applicable law and in accordance with the technical regulations of the Eurasian Economic Union, only an entrepreneur residing in the territory of the Customs Union may be designated as an authorized representative.

In order to get the conformity certificate, the foreign manufacturer must appoint an authorized representative in one of the countries of the Eurasian Economic Union. He represents the interests in the certifying bodies of the Eurasian Economic Union regarding the safety and quality of products and compliance with technical regulations. 1. What is an EAC certificate?

The EAC certificate of the Eurasian Economic Union (EAEU) is an official document, that proofs the conformity of the products with the harmonized technical regulations of the member states of the EAEU. The products, whose conformity with the technical regulations could be confirmed by the certificate of the EAEU, may be moved and sold in the whole customs area of the member states of the EAEU.

2. What is an EAC declaration?

The EAC Declaration of the Eurasian Economic Union (EAEU) is an official document that proofs, that the products meet the minimum requirements of the technical regulations of the EAEU. An EAC declaration is issued by the manufacturer, importer or an authorized representative and listed in the official register. Those products, whose conformity with the technical regulations are confirmed by the declaration, have the permission to be freely moved and sold in the whole customs territory of the member states of the EAEU.

3.What is the difference between EAC certificate and EAC declaration?

The EAC certificate can only be issued after a quality assessment, which has to be carried out by a certification body accredited in one of the member states of the Eurasian Economic Union. The certification is conducted on the basis of technical documentations, company-internal created test reports, or rather test reports provided by accredited test laboratories, as well as on basis of a manufacturing audit on site. The certificate is printed on an official pre-printed form, which has several forgery-proof elements and is authenticated by the signature and seal of an accredited body. The EAC certificate is usually issued for “complex” products that require an extensive control by the authorities.
With the EAC Declaration the manufacturer, importer or authorized representative declares the conformity of his products with the minimum requirements of the technical regulation of the Eurasian Economic Union (EAEU). As distinguished from the EAC certificate, the EAC declaration is issued by the manufacturer or importer himself. All necessary tests and analysis are or made by the manufacturer or in some cases by the laboratory. The applicant issues the EAC declaration himself on a usual piece of paper. The EAC declaration has to be listed in the uniform register of the EAEU by an accredited certification body of one of the member states of the EAEU.

Type examination for EAC conformity assessment

An important step in the conformity assessment procedure is the testing of product samples, during which the conformity of the products with the respective Technical Regulations of the EAEU is verified. In the case of EAC certification, this may only be carried out in accredited laboratories and must follow specific rules. If it is an EAC declaration, the tests can also be carried out in non-accredited laboratories. A test report is then prepared, which contains the test results as well as information about the manufacturer and the test method.
