Due to a lack of attention when filling out documents, typing errors, but also due to changes in the important information in the organization of the applicant and/or manufacturer, the question arises of how changes to EAC certificates and EAC declarations, which have already been issued, can be made. Unfortunately this doesn't seem to be possible. This article explains the reasons why it is not possible to make changes to certificates of conformity, what to do if there is such a need and how to avoid the need for the changes.
Why is it not possible to make changes to EAC Certificates of Conformity?
- This aspect is covered by the decision of the Board of Directors of the Eurasian Economic Commission No. 293 of December 25, 2012 "On uniform forms of the EAC certificate and the EAC declaration in accordance with the requirements of the technical regulations of the Eurasian Economic Union and the rules for their design". It is thus established that the inclusion of information in the EAC Certificate (or in the EAC Declaration), as well as the abbreviation of words (with the exception of generally accepted designations and abbreviations) and any correction of the text are not permitted.
- Data about issued EAC certificates and declarations is entered into the electronic register, which does not allow any changes. This also ensures the reliability of the register. Only the status in the register (valid / suspended / declared invalid) can be changed. This does not make any changes, but adds new information.
What could be done to make changes to Certificates of Conformity
EAC Certificate
If a letter, a number or a comma is missing in the EAC certificate or if more important data has to be changed, e.g. the address of the manufacturer, the whole procedure of the EAC certification must be carried out again. It also means the products must be re-tested accordingly.
EAC declaration
In the case of an EAC declaration, all steps of the conformity assessment must also be carried out. However, it is possible to register a new EAC declaration without carrying out the tests if the address, telephone number, legal form or HS-code of products have changed.
How to avoid changes to EAC Certificates of Conformity?
- Carefully check all data given and entered in the documents.
- Anticipate risks whenever possible. For example, accountability for any changes in the contract can be provided for.
