On November 26th, 2021 a public discussion began concerning the changes in the resolution of the board of directors of the Eurasian Economic Commission No. 293 of December 25th, 2012. This approves the uniform forms of EAC certificates and EAC declarations of the technical regulations of the Eurasian Economic Union / Customs Union (TR EAEU / TR CU).
The public discussion will last 45 days and is expected to end on January 10, 2022.
Objectives of the changes
The changes have the following objectives:
- To simplify the procedures for replacing certificates and declarations of conformity in the event of changes that do not affect product safety
- To relieve applicants of unnecessary financial burdens
- To minimize the risks of importing products into the EAEU that do not meet the mandatory requirements
- To simplify product traceability for the end user
Provisions for electronic EAC certificates and declarations
Important changes initially concern the inclusion of provisions on electronic EAC certificates and declarations. New sections are added clearly stating that the electronic record of the EAC certificate and the declaration in the unified register is a certificate of conformity in electronic form. Such electronic documents have the same legal force as documents on paper. In addition, an electronic document will be given priority in the event of contradicting information.
In this context, the amendments also point out that certificates of conformity may be issued in electronic form without issuing a paper copy. In this case, it will be noted in the unified register that the document was not made out on paper and that a paper version is not available.
This helps applicants considerably and relieves the financial and time burden of having to replace a paper document if it is lost, for example.
Rules for replacing the EAC certificate and the EAC declaration
A new paragraph has been added to the changes. This establishes that the replacement of the EAC certificate and the EAC declaration in accordance with the Schemes approved by the Council of the Eurasian Economic Commission No. 44 of April 18, 2018. This establishes the possibilities of a "simple" renewed issue of certificates of conformity without additional tests.
An important clarification is also included: In the event of the exchange of certificates of conformity and their attachments, the circulation of products will not be suspended for the time necessary for this exchange.
QR code in the EAC certificates and declarations
According to the changes, the QR codes will be added to paper versions of EAC certificates and declarations. This will enable a quick switch to electronic versions of documents.
This is a solution to the problem towards unscrupulous applicants, as the electronic version of the document instantly shows its current status, which cannot be quickly verified on paper. In addition, such a solution will help simplify product traceability for the end user.
Requirements for GLN and GTIN numbers
The requirements for the mandatory presence of GLN numbers in unified registers are established by the Decree of the Government of the Russian Federation No. 1856 of November 18, 2020.
In the project it is determined that the GLN number or the global location number (if available, at the choice of the applicant) is included in the field with information about the product.
If available, the international GTIN number is also given in the EAC certificate and in the declaration at the choice of the applicant.
Additional information
In the form of a certificate of conformity, the field with the reasons for the issue should be supplemented with the following information: number and date of the creation of the report of the production status analysis, name of the certification body and registration number of the accreditation certificate.
As additional information, the amendments provide that the information on the registration number and the date of registration of the EAC certificate / declaration are replaced by the entry "instead issued" (when the EAC certificate / declaration is reissued). In addition, information about the distribution of the certificate for series production products that have passed the tests from the date of manufacture of the samples are made, stating the date of their manufacture.
For an EAC declaration, such a field should contain additional information about a contract with a manufacturer, including a foreign one, which guarantees the conformity of the products delivered to the EAEU area with the requirements of the technical regulations and is responsible for their non-compliance.
