On July 19, 2021, a public discussion began on two draft amendments to the lists of foods for which a confirmation of conformity (or information on such a document) must be submitted in addition to a customs declaration. A confirmation of conformity (EAC declaration or certificate of state registration) proves that the product meets the requirements of TR CU 027/2012 On safety of particular types of special foodstuff including dietary, curative and preventative nutrition and of TR CU 029/2013 On safety of food additives, flavor enhancer and processing aids.
The public discussion ends on August 18, 2021. The changes will come into force on January 1, 2022.
The HS-Codes of goods are to be changed in both lists. For the list of foods according to TR CU 027/2012 the HS-Code for instant herbal tea (plant-based), mate or Paraguay tea is updated: the HS-Code 2106 90 920 0 is replaced by the HS-Code 2106 90 930 0.
With regard to food that falls under TR CU 029/2012, the changes to the HS-Codes affect the following groups:
- Sweeteners: old HS-Code - 934 99 900 0, new HS-Code - 2934 99 800 0
- Fragrances (mixtures of essential oils, mixtures of fragrance extracts, mixtures of extracted resins, mixtures of synthetic fragrances, mixtures of two or more fragrances): old HS-Codes - 106 90 590 0, 2106 90 980 9, new HS-Codes - 2106 90 580 0, 2106 90 980 8
- Organic, anionic surfactants, also packaged for retail sale: old HS-Codes - 3402 11 900 0, new HS-Codes - 3402 31 000 0, 3402 39 000 0
- Organic fungicides and disinfectants: old HS-Codes - 808 92 900 0, 3808 94 900 0, new HS-Codes - 3808 92 800 0, 3808 94 800 0. In addition, the HS-Codes 3808 59 000 5 is to be added
- Plain polyester: old HS-Codes - 3907 20, new HS-Codes 3907 21 000, 3907 29
All products listed in TR CU 027/2012 are subject to state registration. State registration or EAC declaration is provided for products from the list according to TR CU 029/2012.
