On July 21, 2021, a public discussion began on the draft of the amendments to the resolution of the Board of Directors of the Eurasian Economic Commission No. 41 of March 20, 2018. This defines the procedure for registering, suspending, renewing and revoking EAC declarations. The EAC declaration of the Eurasian Economic Union is proof that the products meet the minimum requirements of the technical regulation of the Eurasian Economic Union - EAEU. The public discussion lasts until August 31, 2021.
The document introduces the following changes:
- Procedure for registering the EAC declaration
The first changes concern the expansion of the options for registering the EAC declaration by the certification body. Section 4 of the draft introduces the possibility of submitting an EAC declaration, accompanying documents and information in the form of paper documents directly by the applicant or by a courier service.
- Period of performance when registering the EAC declaration
Another important change concerns the performance period when registering an EAC declaration. Section 8 of the draft stipulates that the decision-making time of a certification body about the registration of an EAC declaration or the rejection of the registration is shortened from 5 working days to 3 working days from the date of receipt of the EAC declaration.
In the event of a refusal to register an EAC declaration, the certification body nevertheless undertakes to state the reason for such a decision.
- Simplified registration of the EAC declaration
The possibilities of a simplified acceptance of the EAC declaration are also determined in the draft. A simplified acceptance of the EAC declaration means that the applicant does not have to submit any new documents. In section 15, a name change by the manufacturer and / or the applicant is added to the other cases. In this case, documents must be submitted confirming the name change and its successor (the requirement is contained in the new clause 15.1).
The list of cases in which the replacement of the declaration of conformity and its annexes is not required and is done at the discretion of the applicant is expanded. This applies to the change in the position, last name, first name and patronymic (if any) of the head of the applicant organization or the person of the applicant organization who is authorized to accept the EAC declaration according to the legislation of the member state (with indication of the name and the details of the approval document).
The draft emphasizes the responsibility of the applicant and the certification body that registered the EAC declaration according to the simplified scheme (this is listed in separate section 15.2 of the rules).
In the new edition, the procedure for registering the EAC declaration should come into force after 180 calendar days from the date of the official publication of the decision.
