On September 9, 2022, the public discussion of the draft of the technical regulation of the EAEU for nicotine-containing products will begin.
The technical regulation will cover products related to smoking and nicotine consumption (including in the form of salts): from electronic cigarettes and vapes to nicotine-containing chews, as well as components, liquids and cartridges. The technical regulation also includes nicotine-free liquids and liquids with a nicotine content (nicotine salts) of less than 0.1 mg/ml, which are intended for consumption using special devices.
The technical regulation does not apply to the following products:
- Samples
- Products shipped for export outside the EAEU
- Tobacco products made from tobacco leaves
- Medicines and medical devices
- Food
In the case of the conformity assessment of such products, it is planned that it should be carried out in the form of a EAC declaration according to the schemes 3d, 6d (for series production) and 4d (for a batch delivery). For scheme 6d, the manufacturer must have a production facility with a certified quality management system.
The confirmation of conformity of nicotine-containing products can be made at the option of the applicant in the form of an EAC Certification according to schemes 1c, 2c, 3c.
In addition, manufacturers, authorized representatives and suppliers of nicotine-containing products must annually submit to the health authority a report on the composition of nicotine-containing products sold on the territory of a member state of the Eurasian Economic Union (no later than the end of the first quarter of the year following the reporting year ). The report must include a list of all ingredients and their percentage by weight for each item.
The development of the technical regulations started in March 2021, the project was taken over by the Ministry of Economy of the Republic of Armenia. The discussion will last from September 9th to November 30th, 2022.

@chen4yuan, thank you for the comment. This technical regulation is being developed now. It supposes to apply for nicotine-containing products that are not tobacco products. These include, for example, e-cigarette or vape cartridges, refill liquids, chewing and drinking products that contain nicotine, including in a more concentrated form in the form of salts.
In the draft of this regulation "heated tobacco product (heated tobacco)" are included.
It is unknown when the regulation is adopted.

It’s just a sentence in the above article confused me. It says “ The technical regulation does not apply to Tobacco products made from tobacco leaves”, but heat not burn sticks are mostly made of tobacco leaves.
It’s good to make clear that HNB products will be included in this draft regulation.
This new regulation should apply for the products with these features:
- the formation of an aerosol inhaled by the user;
- The presence of nicotine in the aerosol inhaled by the user;
- the absence of tobacco burning (smouldering);
- use exclusively with special devices - nicotine delivery systems (NDS)
