On April 12, 2021, a public discussion on the draft decree of the Government of the Russian Federation regarding the invalidation of test reports issued by test laboratories during the EAC certification began.
On April 12, 2021, a public discussion began on the draft decree of the Government of the Russian Federation regarding the invalidation of the Test laboratories issued test reports .
According to the requirements established by the draft, the test reports will be invalidated based on the decision of the head of the Rosaccreditation (Ministry of Economic Development and National Accreditation System in Russia).
Test reports and other types of documents produced by the test laboratories become invalid in the following cases:
- The requirements of the laws of the Russian Federation were not followed. This also includes requirements that are contained in the Technical Regulations, in the Federal Law No. 412 “On Accreditation in the National Accreditation System”, in the requirements of the EAEU and in the standards GOST ISO/IEC 17025-2019 and GOST R 58973-2020
- Test reports are issued without carrying out tests
- There is no laboratory at the place of activity indicated in the register of accredited persons
- The scope of the tests carried out does not correspond to the scope of the test laboratory
- Tests were carried out during the suspension of accreditation
- The test reports issued by a non-accredited testing laboratory were used, while the requirements specify the mandatory testing in an accredited laboratory
- Accreditation of the test laboratory was revoked based on the results of state control (in case violations affected the test results)
- The laboratory did not comply with the decision to invalidate the results of its activities
- Testing of products was incomplete, methods and equipment were used incorrectly or inappropriately, or the measuring instruments were unreliable
The declaration of invalidity is determined within the framework of state supervision, during the confirmation of the competence of the test laboratory or other types of control. The decision to invalidate the test reports must be submitted to the Rosaccreditation within 3 working days from the date of such a decision.
The document was developed by the Russian Ministry of Economic Development together with the Rosaccreditation. This document is based on the requirements of the Federal Law No. 460 of December 22, 2020 and Federal Law No. 425 of December 2, 2020, 2019.
The public discussion should end on April 30, 2021. The government of the Russian Federation will then examine the document. Once approved by the government, the document will take effect on September 1, 2021.
