On June 8, 2021, a public discussion began on the draft of the board of directors of the Eurasian Economic Commission for the introduction of changes to the Technical Regulation TR CU 009/2011 "On the safety of perfumes and cosmetic products". The Technical Regulation set minimum requirements for the safety of products during the EAC Certification, EAC Declaration or state registration.
The conformity assessment for perfumes and cosmetic products is carried out in the form of state registration. According to the procedure, certificates of state registration for perfumes and cosmetic products for which the changes have been made, issued before May 5, 2020, are valid until May 5, 2023 inclusive.
The drafts put up for discussion also provide for a new section to be added to this subsection of the procedure. As a result, the state registration certificates issued before May 5, 2020 and which must be replaced are valid up to and including May 5, 2023.
The replacement of the certificate of state registration (or the annex to the certificate) without additional or re-examinations is possible in accordance with Resolution No. 44 of April 18, 2018 “On the Schemes of Conformity Assessment” in the following cases:
- typos were found in the certificate or its annex
- the manufacturer has changed the organizational and legal form or the location (address of the legal entity)
- the applicant has changed the organizational and legal form, the location (address of the legal entity) or the business address (if different)
The public discussion of the drafts of the state registration certificate for perfumes and cosmetic products will last 60 days. The planned closing date is August 7th of this year.
The changes should prevent the applicant from having the certificate of state registration reissued and thus producing perfumes and cosmetic products that do not meet the requirements of the new edition of the technical regulation TR CU 009/2011.
