On February 18, 2021, a public discussion began in the Council of the Eurasian Economic Union. The project for the formation and introduction of the Register of chemical substances and mixtures of the Eurasian Economic Union, as well as the notification of new chemicals is on the agenda.
The Council of the Eurasian Economic Union decided to develop an appropriate document in order to fulfill the requirements of clauses 12 and 47 of the technical regulation "On safety of Chemicals" (TR EAEU 041/2017) adopted on March 3, 2017 and clauses 30 of Appendix No. 1 to the Rules of Procedure of the Eurasian Economic commission of December 23, 2014.
According to the draft decision, the member states of the Eurasian Economic Union shall undertake:
- to submit to the Eurasian Economic Commission information on state bodies (organizations) whose competence includes the formation and introduction of the register of chemical substances and mixtures of the Eurasian Economic Union as well as notification of new chemicals by July 1, 2021
- to submit to the Eurasian Economic Commission information on state bodies which are authorized to conduct state registration of chemical substances and mixtures by September 1, 2021
- to ensure that the competent authorities (organizations) with the participation of industry representatives carry out a chemical substances inventory (including components of mixtures) in circulation and are planned for circulation in the customs territory of the Union, and submit the relevant information to the Commission by July 1, 2022
- to ensure the formation by the competent authorities (organizations) of the national parts of the register in the part that is related to chemical substances, and the submission of relevant information to the Commission by September 1, 2022
The purpose of the adoption of the project for the formation and introduction of the register of chemical substances and mixtures, as well as notification of new chemicals is to ensure the conformity assessment of chemical products. The register should be divided into two issues: chemical substances and mixtures. Each chemical substance or mixture is required to be assigned an individual number in order to be included in the register. Such a number should have the following form: Х.ХХХХХХХХ. The first character is a letter denoting the product category (V stands for chemical substance, S – for mixture), the rest of the characters are an 8-digit individual serial number. If the register already contains information about a substance or mixture, then a new number should not be assigned to the product in order to avoid duplication.
The notification procedure is carried out for new chemicals. Only monomers (but not the polymers) are subject to this procedure. There are two ways to carry out the notification: during the state registration, and also in a separate procedure.
Until November 1, 2024, applicants have the right to submit information about a chemical substance in order to include it in the register without going through the notification procedure. In this case, special documents (information) must be provided. They have to be able to confirm the circulation of this chemical substance in the customs territory of the Union before the date of entry into force of the technical regulation of the Eurasian Economic Union TR EAEU 041/2017 "On safety of Chemicals" (TR EAEU 041/2017) dated March 3, 2017. Such materials may include the following documents (information):
- contract for the supply of a chemical substance
- consignment notes
- information on the presence of the chemical substance in the national register of chemical products of the Member State
The discussion of the project will be completed on April 1.
