The changes in the Eurasian Economic Union's Technical Regulation TR EAEU 041/2017 “On Safety of Chemical Products” , initiated by the Ministry of Industry and Trade of the Russian Federation, are intended to specify the scope of the current regulation. The adopted amendments will come into force 180 calendar days after their official publication. The Technical Regulation itself was approved in 2017 and will start functioning in June 2021.
The amendments include the following:
- the chemical products and mixtures are subject to state registration in the form of notification if the information on chemical products is included in the Registry of Substances and Mixtures of the Union and / or is provided in international, regional, and national databases. This applies neither to the products containing banned and / or restricted chemicals nor to the products classified as carcinogenic and / or mutagenic, and / or reprotoxic substances of Classes 1 and 2;
- the chemical products and mixtures manufactured or imported by a single manufacturer/importer in quantities exceeding 1 ton per year and classified as carcinogens and / or mutagens and / or reprotoxicants of Class 1 and 2, are liable to the certification of conformity before their release into circulation on the customs territory of the Union;
- the need to monitor the distribution of chemical goods produced or imported in quantities less than 1 ton;
- new chemicals, restricted substances and mixtures classified as carcinogens and / or mutagens and / or reprotoxicants of Class 1 and 2 are subject to state registration in the form of the permit procedure.
The document additionally suggests disregarding Annex No. 4 to the Technical Regulation.
