The Technical Regulation of the Eurasian Economic Union TR EAEU 037/2016 On the restriction of the use of certain hazardous substances in electrical and electronic equipment is largely harmonized with RoHs Directive 2011/65/EU.
The technical regulation restricts the use of 6 hazardous substances for health and the environment: lead, mercury, cadmium, hexavalent chromium, polybrominated biphenyls (PBB), and polybrominated diphenyl ethers (PBDE).
The regulation came into force on March 1, 2018. However, the Eurasian Commission gave manufacturers two years to modernize their production processes so that the products fully meet the requirements of the regulation. During this time, the products could be sold without proof of conformity according to TR EAEU 037/2016.
This transition period ends on March 1, 2020. It means, that from this day no products without EAC-conformity certificates according to TR EAEU 037/2016 may be manufactured, sold or imported in the area of the Eurasian Economic Union (EAEU).
Many products are currently sold that have all the necessary certificates and declarations and are marked with the EAC-marking. It’s also important to know, that that they are not certified according to TR EAEU 037/2016. From March 1, 2020, these products may no longer be sold without a certificate of conformity in accordance with TR EAEU 037/2016. Marking with EAC is also considered to be illegal, because the conformity of the product with the requirements of ALL technical regulations under which it falls, must be confirmed for its use. The manufacturers/importers will be penalized for the illegal use of the EAC-marking.
The devices listed in Appendix 1 to TR EAEU 037/2016 fall under the scope of TR EAEU 037/2016:
- electrical household appliances: clocks, electric pumps, chargers, extension cables etc.
- electronic data processing machines and devices, which can be connected to electronic data processing machines: PC, keyboard, mouse, tablet, computer, printer, projector
- telecommunication equipment: telephone, smartphone, radio
- copy machines and electronic office equipment
- power tools
- light sources and lighting equipment, including appliances that can be installed in furniture
- electronic musical instruments
- slot and game machines
- cash machines and electronic cash registers
- cables for use at rated voltages up to 500 volts, except fiber optic cables
- automatic and safety switches
- safety and fire alarms
Confirmation of conformity with the Exigences of the technical regulations TR EAEU 037/2016 takes place in the form of the EAC-declaration and may be REPLACED by the EAC-certification on request.
