India, like some other federal states, has no unified federal real estate register. There are special registration and registry systems at the state level, the part of which is different from the remaining ones. Computer systems of registration, register management and organization of online access to them are now being implemented under a federal program in the majority of states.
The procedure for registration and register maintenance in the majority of states is regulated by the 1908 Registration Law.
Depending on a state, registers are maintained either in local languages, or are duplicated in English.
Registers store information about main specifications of a real estate object (type, address, area etc.), and rights to it.
Information in the register
- Basic characteristics of a real estate object (type, address, area etc.)
- Rights of ownership (gained as a result of inheritance, gift, acquisition, provision by the government or court)
- Rights of lease for a period of over 12 months
Search in the register is possible by:
- address
- cadastral number
- confirmation of title to real estate
- receipt of information about the real estate item
- debt collection
- analysis of prices for real estate
- other commercial and analytical purposes
Online search is possible only in those states where there is an electronic real estate register. The possibility of online search by personal data of an individual is usually not available.
An electronic extract does not have legal effect and may be applied for information only. Extract in a paper form with a stamp is obtained directly in the register and is then apostilled.
Extracts from registers may be obtained in electronic or paper form.
Extracts from the registers of India may be used for:

Apostilled extracts from India
India joined the Hague Convention on simplified legalization of documents on October 26, 2006. On July 14, 2005 the Convention came into force.
Thus, documents issued in India are subject to legalization based on the apostilling procedure, after certified translation such documents acquire full legal force on the territory of all other Hague Convention Member States.
As a rule of thumb, apostillation of extracts takes about two weeks.
