Data on real estate in China (PRC) is stored in the real estate register and land registers.
First land registers appeared in China back in Middle Ages and were used both for the protection of property rights and for fiscal purposes. Due to a complicated political situation during the nationalist period, the original comprehensive land registration system was not implemented. After establishment of the PRC the register was not originally introduced due to the fact that the entire land was in state or collective ownership. Establishment of the modern state registration system began in 1980-s. In 2007 the Property Law was adopted. For several years registration was held by local authorities, however since March 1, 2015 Temporary real estate registration rules aimed at establishment of the general nationalist real estate registration system came into force. According to new rules, the Ministry of Land and Resources guides and monitors the real estate registration system all over the country. A permanently acting register is being established.
The Ministry of Land and Resources comprises the Real Estate Registration Centre.
Duties of the Real Estate Registration Centre:
- conduction of studies of all real estate types
- standardization activities
- real estate registration activities
- collection of information required for real estate registration
- provision of replies to public requests
- performance of legal work related to real estate registration issues
- performance of analytical real estate registration work
- other activities for the benefit of the Ministry of Land and Resources
Information about land use rights is stored in a separate register.
The Real Estate Register in China is only partially public. The general descriptive information and part of data on rights are provided upon request after payment of a duty. However, full information about real estate owners and users is provided only to employees of law enforcement and state authorities.
Records in the register contain basic information about an object and rights to it.
Extracts from the Register may be obtained either in electronic or in a paper form with consular legalization.
Extract from the Real Estate Registers of the PRC may be used for:
- confirmation of title to real estate
- receipt of information about the real estate item
- debt collection
- analysis of prices for real estate
- other commercial and analytical purposes

The requests shall be processed within one business day. Courier delivery of the apostilled extract shall be paid additionally according to the courier tariff rates.
Legalization of extracts from China
China is not party to the Hague Convention cancelling requirements of diplomatic or consular legalization of foreign official documents. Thus, the apostilling procedure is not applied in China. Documents compiled by authorities or with participation of Chinese authorities and designed for use abroad shall be legalized in a consulate institution.
